What is Dual Agency?
- The broker acts as an agent for both the Buyer and Seller in the transaction.
- The broker makes every reasonable effort to stay impartial.
- Prior to being a dual agent the broker may have obtained information about the Seller or Buyer, which, if disclosed, could harm the bargaining position of that party.
- Both parties agree that the broker will not be liable for not disclosing any information which the broker feels would harm one party and benefit another.
- Both parties give up their right to that the broker’s undivided loyalty.
